These Terms & Conditions ("Terms") govern your access to and use of Kquotely ("the Service"), operated by [Company name TBC] ("we", "us", "our"). By registering for an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
These Terms form a legally binding contract between you ("you", "the Customer") and us. They are governed by the laws of England and Wales.
Kquotely is a software-as-a-service (SaaS) product that enables you to add a quote request widget to Squarespace websites. The Service includes an admin dashboard, quote management tools, email notifications, and related features as described on our website.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will endeavour to give at least 30 days' notice of any material changes or discontinuation.
You must be at least 18 years old and have the legal capacity to enter into a contract to use the Service. By registering you confirm this.
You are responsible for maintaining the security of your account credentials. You must enable two-factor authentication (2FA) — this is mandatory and enforced by the Service. You are responsible for all activity that occurs under your account.
You must not share your account credentials with others. If you believe your account has been compromised, notify us immediately at [email protected].
New accounts receive a 30-day free trial. No credit card is required during the trial period. At the end of the trial, the Service will be restricted unless you provide a valid payment method and subscribe. Trial accounts that have not converted will be automatically deleted after 30 days of expiry.
We reserve the right to modify or end the free trial offer at any time without notice.
The Service is provided on a subscription basis at £15 per site per month (or such other price as displayed at the time of subscription). Prices are inclusive of VAT where applicable.
Payment is processed by Stripe. By subscribing you authorise us to charge your payment method on a recurring monthly basis. Subscriptions renew automatically unless cancelled.
If a payment fails, we will notify you and attempt to retry. If payment remains outstanding after 7 days, your account may be suspended. Data is retained for 30 days following suspension before permanent deletion.
You may cancel your subscription at any time via the billing portal in your account dashboard. Cancellation takes effect at the end of the current billing period — you will retain access until then.

When you use the Kquotely widget on your Squarespace site, you collect personal data from your customers. You are the data controller for that data. Kquotely acts as your data processor.

By using the Service you agree to our Privacy Policy, which forms part of these Terms and constitutes a Data Processing Agreement between us.
The Service, including its code, design, branding, and content, is owned by us and protected by copyright and other intellectual property laws. You may not copy, reproduce, or create derivative works from any part of the Service.
You retain ownership of all content you upload or submit through the Service (including quote data). You grant us a limited licence to process that content solely to provide the Service to you.
We aim to provide the Service with high availability but do not guarantee uninterrupted access. We are not liable for downtime caused by maintenance, third-party services (including Squarespace, Stripe, or hosting infrastructure), or circumstances beyond our reasonable control.
We will endeavour to perform scheduled maintenance outside peak hours and provide advance notice where possible.
To the maximum extent permitted by law, our total liability to you for any claim arising from your use of the Service shall not exceed the total amount you paid to us in the 12 months preceding the claim.
We are not liable for indirect, incidental, consequential, or punitive damages, including loss of revenue, loss of data, or loss of business opportunity, even if we have been advised of the possibility of such losses.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
Either party may terminate this agreement at any time. You may terminate by cancelling your subscription and deleting your account. We may terminate your access immediately if you breach these Terms.
Upon termination, your data will be retained for 30 days to allow for export, after which it will be permanently deleted.
We may update these Terms from time to time. We will notify you of material changes by email at least 30 days before they take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you may cancel your subscription before the changes take effect.
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
